A FORMER marine jailed for shaking a baby to death has appealed against his conviction.
Colin Scholey, 29, was found guilty of causing fatal head injuries to four-month-old Thomas Preece in July 2011 and sentenced to six years in prison at Reading Crown Court.
The baby died 13 hours later after being taken to hospital from his girlfriend’s home in Sedgewell Road, Sonning Common, in June 2009.
Scholey, of Blounts Court Road, had denied manslaughter and told police that Thomas received the fatal injuries after a 15-month old girl in his care accidentally fell from a sofa onto the baby in the living room.
He is now challenging the safety of his conviction in the Appeal Court. Lord Justice Treacy, sitting with Mr Justice Spencer and Mrs Justice Simler, agreed to adjourn the case so that Scholey’s legal team can gathering fresh evidence.
No date was set for the case to return to court.
